To avoid all litigations on the apparent condition and number of goods or parcels entrusted for transportation, Art Régie Transport.com ensures that “observations” (a condition report) are taken at different stages of transportation (collection and delivery), for clear and detailed identification of damages or missing items that may exist prior to transportation or arise subsequently.

DURING SENDING THE CHECKING OF GOODS AND PACKAGES IS CARRIED OUT BY THE DRIVER :

In accordance with Article 7 of our Terms and Conditions, the driver must carry out care checks of the apparent state and compliance (number, type, size…) of the goods and packages to be sent:

The collection order is established according to the reality of the good he is responsible for. If the driver reports discrepancies or damages to the goods to be transported, he will establish a written statement with the shipper: the “observations” will be combined on the collection order, which he will date, and sign with the shipper.

At the moment of sending, the « observations » have the aim of reliably recording any possible disparities, deteriorations or indications of dilapidations before the carrying out of transportation.

DURING DELIVERY, THE CHECKING OF GOODS OR PACKAGES IS CARRIED OUT BY THE RECIPIENT :

In accordance with Article 8 of our Terms and Conditions, the recipient who receives the delivery must carry out care checks of the apparent state and compliance (number, type, size…) of the goods and packages sent, in accordance with the information of the delivery order, before dating and signing it with the driver. The recipient should report any damages to the driver and co-sign the delivery order fully and completely.

If relevant, the « observations » aim to prove the existence of damages or loss at the time of delivery.

The recipient should confirm these « observations » to Art Régie Transport.com and the transporter (whose name and contact details are on the delivery order), by a registered letter with acknowledgment of receipt, within three working days of delivery. The recipient who takes delivery without « observations » should receive goods corresponding in all respects to the statement in the delivery order. In this case, if the recipient notices any damages to goods during transportation after delivery, it is their responsibility, according to the procedures of Article 133-3 of the Commercial Code, to address to Art Régie Transport.com and the transporter (whose name and contact details are on the delivery order), the “observations” accounted for within three working days of delivery by a registered letter with acknowledgment of receipt, proving the responsibility of the transporter. Otherwise, it should be noted that no warranty action could be carried out against Art Régie Transport.com or its substitutes.
